Attorneys Deragon and Davidson Publish Article in NH Bar News Regarding Severance Agreements

Beth Deragon and Kathleen Davidson had an article recently published in the NH Bar News April 2024 edition, discussing the impact of the McLaren decision on severance agreements.  A little over a year ago, the NLRB issued a ruling that certain common confidentiality clauses and non-disparagement provisions violated employees’ rights to engage in concerted activity.  Concerted activity is a fancy way of saying discussing workplace conditions and pay, such as when employees decide to unionize.  This decision left a lot of uncertainty in the employment bar.  Beth and Kathleen shared their experiences in the past year and what they have seen employers do in response to McLaren.
